Mr. Dr. Rabindra Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 30-11-2018 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in Kochas (Parsathua) P.S. Case No. 136/2018, instituted for offences under Sections 399, 402, 411 and 414 of the Indian Penal Code read with Sections 25(1-b)a, 26 and 35 of Arms Act.

It is alleged in the written report that on getting information that five criminals have assembled for preparation to commit occurrence, police party reached at Nainakon More at NH-30 and apprehended five persons including these petitioners. From their possession country made gun, three live cartridges and two motorcycles were recovered.

Patna High Court Cr.Misc. No.69013 of 2018(2) dt.30-11-2018 2/2 Learned counsel for the petitioners has submitted that seizure-list is part of F.I.R. which does not bear signature of any of the accused persons. In the seizure-list, it is mentioned that incriminating articles have been recovered from co-accused Manjeet Kumar @ Manjeet Yadav and Deepak Kumar. Petitioners are in custody since 20.07.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Rohtas at Sasaram in connection with Kochas (Parsathua) P.S. Case No. 136/2018, subject to the conditions that both the bailors shall be the close relative of the petitioners. (Sanjay Priya, J.) rakhi U T
