The petitioner seeks bail in connection with Deoria P.S. Case No. 14 of 2020, dated 04.02.2020, instituted for the offences under Sections 399 and 402 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act. The petitioner claims to be a person of clean antecedent and is in custody since 05.02.2020. On secret information that some miscreants have assembled near a banyan tree for commission of some

Patna High Court CR. MISC. No.20171 of 2020(2) dt.18-06-2020 2/2 offence, a raid was conducted. Some of the accused persons including the petitioner were arrested. From the possession of the petitioner, a dagger, a mobile phone and one live cartridge are said to have been recovered.

It has been submitted on behalf of the petitioner that in order to justify his arrest, the aforesaid recovery has been saddled upon him.

Regard being had to the clean antecedent of the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Deoria, Muzaffarpur in connection with Deoria P.S. Case No. 14 of 2020.

The application stands allowed.
