2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 379, 354, 504, 506, 34 and 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

3. Petitioner, who is husband of opposite party no2., is said to have ousted the opposite party no.2 from her matrimonial home in association of his family members over the dowry demand.

4. Learned counsel for the petitioner submits that the allegation of demand of dowry and torture is false and

5. However, it is the O.P. No.2, who is not willing to stay with the petitioner. Further, it has also been submitted that the present marriage with the complainant was a love marriage and it would also appear from the S.A of the complainant that from her first marriage, the complainant had five children and she was in a relationship with the petitioner for the past 5 years.

In such view of the matter, let the above named petitioner, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge IIIcum-A.C.J.M. III, Bagaha, West Champaran, Udakishunganj, Madhepura, in connection with Complaint Case No.517 of 2023 subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482 (2) of the B.N.S.S., 2023 and subject to the further condition that the petitioner shall co-operate in the investigation/trial.
