The petitioner apprehends his arrest in a case registered for offences punishable under Sections 302, 201/34 of the IPC.

Allegation is that the deceased had gone to his sasural and the dead-body was found and it is alleged that his in-laws has killed him. The petitioner is brother of the wife of the deceased.

It is contended that there is no evidence at all against the petitioner and he has been implicated on the basis of suspicion. It is further contended that the ex-husband of Kamini Devi, Rokki Rajak and Kamini Devi the wife of the deceased have already been granted anticipatory bail vide Annexure 3 by

Patna High Court Cr.Misc. No.65190 of 2018(2) dt.05-11-2018 2/2 different co-ordinate Benches of this Court. So far the motherin-law and the father-in-law are concerned, they were apprehended and subsequently they have also been granted regular bail.

Having regard to the facts and circumstances of the case, let the abovenamed petitioner be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Ballia P.S. Case No. 328 of 2017, on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
