JUSTICE SUDHIR SINGH ORAL ORDER 16-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 399, 402 and 412 of the Indian Penal Code and Sections 25(1-b)A, 26 and 35 of the Arms Act.

Allegation against petitioner is that he along with other accused persons were apprehended while they were trying to flee away after seeing police party and from their possession arms and ammunitions were also recovered.

It has been submitted on behalf of petitioner that he is in custody since 25.5.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. It is alleged that one loaded country made pistol is said to have been recovered from possession of petitioner. No compliance of Section 100 of the Code of Criminal Procedure is made.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.53463 of 2016 (2) dt.16-12-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Patna City, Patna, in connection with Chowk P.S. Case no. 95 of 2016.
