Aggrieved by an order passed on 04.02.2013 by the Judicial Magistrate, 1st Class, Patna City in Complaint Case No. CA958 of 2008 refusing to discharge the petitioner in that case, the petitioner is before this Court.

I have perused the order and I find that the learned Magistrate has considered the material facts which are required to be considered by him and then had refused to discharge the petitioner.

Petition appears meritless and the same is dismissed. Any order staying the proceedings in the court below is hereby vacated.
