Petitioner is apprehending his arrest in Complaint Case No. 1022(C) of 2013 pending in the court of Smt.
Indrani Kisku, Judicial Magistrate, 1st Class, Patna registered for the offence under Sections 406, 420 of the Penal Code. Complainant of the present case has business relationship with father of the petitioner. It is said that advance was made by the complainant to the father of the petitioner for purchasing plastic laminated sheets, amount
Patna High Court Cr.Misc. No.40303 of 2015 (3) dt.08-10-2015 deposited in Syndicate Bank, Bara Bazar Branch, Kolkata Account No. 9505-2010007479 of his father. From the complaint petition it appears that when supplies were not made as agreed for which advance was made, present complaint was filed. It is submitted that father of the petitioner has been admitted to the privilege of bail in the event of arrest by another Bench of this Court under order dated 01.10.2015 passed in Cr. Misc. No. 39789 of 2015 and it is said that complainant having not made any advance to him, petitioner also deserves the similar privilege. Be that as it may, as father of the petitioner has been admitted to the privilege of bail in the event of arrest under order dated 01.10.2015, this petition is also disposed of exactly in the same terms which is contained in Order No. 2 dated 01.10.2015 passed in Cr. Misc. No. 39789 of 2015.
