Petitioners apprehend their arrest in connection with Sahebpur Kamal P.S. Case No. 47 of 2014 registered for the offences punishable under Sections 147, 149, 323, 353, 307, 379 of the Indian Penal Code.
The petitioner no. 1 has been arrested and as such prayer has been made to withdraw this application on his behalf. Prayer is allowed. Accordingly, this application on behalf of petitioner no. 1 stand dismissed as withdrawn. Allegedly, when the informant along with Anchal Amin was making inquiry regarding land of middle school in question, the petitioners and others came there, they snatched map
Patna High Court Cr.Misc. No.48892 of 2014 (2) dt.23-04-2015 and burnt the same after snatching tape and they thrashed the informant and tried to take away towards the building of the school and further they snatched wrist watch and cash of Rs. 500/- . Submission is of false implication, under conspiracy the land has been encroached by Bhola Das and others and some persons have constructed house under Indira Awas Yojna on the land of school and due to this reason they have been implicated in this case to which the learned APP opposes.
In the facts and circumstances stated above, the petitioner nos. 2, 3 and 4 above named, in case of their surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Sahebpur Kamal P.S. Case No. 47 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
