ANJANA MISHRA ORAL ORDER 22-05-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Dumrao P.S. Case No.494 of 2018 for allegedly having committed the offence under Section 272, 273 of the Indian Penal Code and Section 3(2)/9(2) of the Bihar Excise Prohibition Amendment Act, 2018.

Learned counsel for the petitioner submits that there were no recoveries from the conscious possession of these petitioners, but on the statement of certain co-villagers their names have been brought in.

Having considered the facts and circumstances and that there are no criminal antecedents against these petitioners, let the

No. 19221 of 2019(4) dt.22-05-2019 2/2 petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II-cum-Special Judge, (Excise), Buxar, in connection with Dumrao P.S. Case No.494 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
