JUSTICE BIRENDRA KUMAR ORAL ORDER 10-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 447/504/506/307/302 and other minor sections of the Indian Penal Code.

The allegation of giving fatal blow to the deceased with sword is against co-accused Ajay Rai. There is general and omnibus allegation against others including the petitioner of commission of assault with lathi etc.

Submission is that both sides are agnates and for trivial dispute of property the occurrence allegedly took place. Considering the facts and circumstances, let the

No.12874 of 2017 (2) dt.10-05-2017 2/2 petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Mr. A.K. Singh, learned Judicial Magistrate, 1st Class, Muzaffarpur/Successor Court in connection with Paroo Police Station Case No.154 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
