JUSTICE SUDHIR SINGH ORAL ORDER 23-04-2015 The petitioner is apprehending his arrest in connection with Hilsa P.S.Case No. 199/2014 for the offences under Sections 147, 148, 149, 341, 323, 384 of the Indian Penal Code and Section 27 of Arms Act.
Heard learned counsel for the petitioner , the State and the Informant.
The prosecution case, in brief, is that on 28.5.2014 at about 7 A.M. when the informant was proceeded from his house to deposit an amount of two lacks , on the way accused persons, namely, Udai Kumar ad Ashok Kumar and two unknown miscreants surrounded him and demanded the said bag but the informant refused. Petitioner no.1 assaulted the informant with butt of the pistol, Ashok Prasad assaulted with lathi causing
Patna High Court Cr.Misc. No.49691 of 2014 (2) dt.23-04-2015 2/2 injury on his back and both fled away with snatching his bag. It is submitted on behalf of the petitioner that the petitioner has falsely been implicated in this case. On behalf of the State it is submitted that there is direct allegation against the petitioner, as alleged. Learned counsel for the Informant has brought to the notice of this Court that anticipatory bail application of other co accused person has been rejected by this Court in Cr. Misc. No. 622 of 2015, vide order dated 08.01.2015.
Considering the aforesaid facts, I am not inclined to grant privilege of anticipatory bail to the petitioner. The payer for anticipatory bail of the petitioner is rejected. (Sudhir Singh, J) singh/- U T
