The petitioner apprehends his arrest in Parbatta (Maraiya) P.S. Case No. 14 of 2017 registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

The informant alleged that his sister was married to Pramod Mandal ten years ago. His sister got two children. Pramod Mandal, the husband of the sister of the informant, developed illicit relation with his sister-in-law Anita Devi and that is why he used to assault his wife. On 15.01.2017, the informant got information that Pramod Mandal, Bhola Mandal, Bilash Mandal, Anita Devi and Sattan Mandal, the petitioner and 2-3 unknown persons concealed the dead body of his sister. The informant made specific allegation against Pramod Mandal, as he used to assault

Patna High Court Cr.Misc. No.16310 of 2017 (2) dt.02-05-2017 2/2 his wife, that he killed his wife. It is further submitted that at best Section 201 of the Indian Penal Code can be made out which is bailable.

Considering the facts aforesaid and the facts that no specific allegation is made against the petitioner that the petitioner ever torture the sister of the informant and the petitioner is not the family member of the Pramod Mandal, the husband of the deceased, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in Parbatta (Maraiya) P.S. Case No. 14 of 2017, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
