Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 354(B), 354(D), 292, 506, 509/34 of the Indian Penal Code, Sections 4/18 of the POCSO Act, 2012 as well as Sections 67(B), 67(C) of the Information Technology Act, 2000.
The allegation against the petitioner is that he edited photograph of a minor girl and made it some sexual coloured and, later on, got it viral on the e-platform. Initially, learned counsel for the petitioner submits
Patna High Court CR. MISC. No.19876 of 2020(3) dt.02-09-2020 2/2 that both were in affairs, however, learned counsel declined to produce any material that the girl had ever proposed to the petitioner either through writing or any message. Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail in connection with Mahila P.S. Case No. 26 of 2020 corresponding to POCSO Case No. 19 of 2020 pending in the Court of learned Additional Sessions Judge-1-cum-Special Judge, Supaul.
Hence, prayer for bail is refused.
Petitioner may renew his prayer for bail after six months or after framing of the charge whichever is earlier. (Birendra Kumar, J) Kundan/- U T
