JUSTICE SUDHIR SINGH ORAL ORDER 09-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 406 and 420 of the Indian Penal Code. Allegation against petitioner is that he started a Stitching Training Centre in the village and took admission of girls on payment of Rs.1000/- each. Thereafter, he left the place cheating those girls.

It has been submitted on behalf of petitioner that he has got no criminal antecedent. The present case is relating to misuse of bail. He has remained in custody for four months. It is further submitted that petitioner shall be present in the court below on each and every date.

On behalf of the State, it is submitted that petitioner was granted bail but due to non-appearance of the petitioner in the court below, his bail was cancelled.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like

Patna High Court Cr.Misc. No.50613 of 2016 (4) dt.09-01-2017 2/2 amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Siwan, in connection with Trial no. 968 of 2015/661/2016 arising out of Siwan Muffasil P.S. Case no. 142 of 2006.

Any how, the petitioner is directed to be present in the court below on each and every date fixed by the court and cooperate during the trial. If petitioner fails to co-operate during the trial, the court below shall be at liberty to cancel bail of petitioner. (Sudhir Singh, J) sudip/- U T
