The petitioner is apprehending his arrest in connection with Vaishali Complain Case No.C1 635 of 2017, Tr. No.2813/2018 registered for offences punishable under Section 498(A) of the Indian Penal Code and Section 3 of Dowry Prohibition Act.

Allegation against the petitioner is of demand by the petitioner and accused persons and thereafter ousting her from the house.

Submission of the learned counsel for the petitioner is that no specific allegation either of demand or of assault is against the petitioner and in spite of that he is still ready to keep her.

Patna High Court CR. MISC. No.18994 of 2019(3) dt.02-07-2019 2/2 Heard learned A.P.P. and the learned counsel for the O.P.no.2, who has submitted that she is ready to reside with the petitioner ..

In the above view of the matter, both the petitioner and O.P.no.2 shall appear before the learned court below on 9.7.2019 and both will file petition that they are ready to reside with each other and on filing of such petition and on taking of the complainant from the court below itself by the petitoner, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Vaishali at Hajipur in connection with Vaishali Complain Case No.C 1 635 of 2017, Tr. No.2813 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is disposed of.
