Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor.

The petitioner prays for anticipatory bail in connection with Ghoshi P.S. case no. 292 of 2016 registered for the offence punishable under Sections 323, 341, 379, 307/34 of the Indian Penal Code.

It is submitted on behalf of petitioner that the allegation against the petitioner is that he has assaulted by but portion of the pistol and the injury is simple in nature. It is further submitted that prior to this occurrence, the mother of petitioner has

Patna High Court Cr.Misc. No.8834 of 2017 (2) dt.03-03-2017 2/2 lodged a case against the informant and as such, present case is lodged in order to pressurize the petitioner. Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail.

Having heard both sides. From perusal of the F.I.R. it is apparent that injury was caused by but portion of the pistol which is simple in nature. As such the bail application of petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/-(Rs. Twenty Five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Ghoshi P.S. case no. 292 of 2016 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
