JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-06-2016 The present application has been filed on behalf of the petitioner Bal Mukund Suman with a prayer for anticipatory bail in connection with Complaint Case No. 70C of 2014 in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 498A, 494, 120B of the Indian Penal Code. The basis accusation is of torture and performing second marriage.

Initially on the submission of the learned counsel for the petitioner that petitioner is ready to keep the complainant as wife with full dignity and honour notices were issued to the complainant on 31.08.2015. On appearance of opposite party no. 2 on the prayer of petitioner the matter was adjourned on 22.01.2016, 17.03.2016 and 18.04.2016. Today, the complainant is present. However, the

Patna High Court Cr.Misc. No.40851 of 2015 (6) dt.27-06-2016 petitioner is not present. On earlier occasion learned counsel for the petitioner has filed an affidavit with regard to payment of arrears.

It is submitted by the learned counsel for the petitioner that he has no instruction from the petitioner. Accordingly, the application is disposed of as not pressed.
