JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 323, 328, 302/34 of the Indian Penal Code.

Petitioner is languishing in jail custody since 18.12.2014 and earlier her prayer for bail was rejected by a coordinate Bench of this court vide order dated 23.06.2015 passed in Cr. Misc. No. 7631 of 2015 but submission on behalf of the petitioner is that having similar allegation, co-accused, Fagu Das has already been granted privilege of bail by this Court whereas rest accused persons have been released on bail by the learned Sessions Judge, Purnea vide order dated 14.09.2016 passed in B.P.

From perusal of the impugned order I find that the case of the petitioner is pending for argument and, therefore, in the aforesaid circumstance, I direct the petitioner to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Purnea in connection with Sessions Trial No. 459 of 2015 arising out of Sadar P.S. Case No. 626 of 2014.
