The petitioners seek bail in anticipation of their arrest in connection with Uchakagaon P.S. Case No. 244 of 2018 dated 16.09.2018 instituted for the offences under Sections 341, 323, 307, 504, 34 of the Indian Penal Code. Over a dispute relating to fixing of fodder cutting machine, an occurrence is stated to have taken place in which the petitioners are alleged to have assaulted the informant by means of iron rod.
The learned counsel for the petitioners has
Patna High Court Cr.Misc. No.69006 of 2018(2) dt.18-12-2018 2/2 submitted that there is counter version of the occurrence vide Uchakagaon P.S. Case No. 246 of 2018. The injuries suffered by the informant are stated to be simple in nature. This Court has further been informed that petitioner Nos. 1 and 2 are old persons aged about 62 and 69 years respectively.
Regard being had to the aforesaid facts as also taking into account that petitioners do not have any criminal antecedents, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, are directed to be released on bail on his furnishing bail bonds of Rs. 10,000/- (ten thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Uchakagaon P.S. Case No. 244 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
