Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Special Case No. 7885 of 2018, arising out of Maner P.S. Case No. 430 of 2018, for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 06.02.2019. He further submits that in the instant case total 60 litres of foreign liquor was seized. He also submits that the name of the petitioner surfaced in the confessional statement of co-accused Shashi Kumar and Kunal Kumar, who were apprehended by the police, have already been granted bail vide
Patna High Court CR. MISC. No.20691 of 2019(2) dt.03-04-2019 2/2 order dated 06.10.2018 in Cr. Misc. No. 61432 of 2018. Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Patna in connection with Special Case No. 7885 of 2018, arising out of Maner P.S. Case No. 430 of 2018.
