The petitioner has preferred this application for grant of regular bail in connection with Barun P.S. Case No. 558 of 2022 dated 24.12.2022 registered for the offence punishable u/s 302 read with 34 of the Indian Penal Code.

As per the prosecution case, the petitioner and the coaccused person are alleged to have committed murder of the informant's husband. The informant has further alleged that at about 7 P.M the petitioner and the co-accused person came to the house of the informant and called her husband for repairing of electric connection but he refused to go with them. Patna High Court CR. MISC. No.21315 of 2023(2) dt.22-05-2023 2/2 away. After 2-3 hours the informant's husband did not return. In the morning at about 6 A.M his dead body was found under the palm tree.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Learned counsel further submitted that the allegation of taking the deceased is against the co-accused person, Ajay Kumar. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 25.12.2022. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Aurangabad in connection with Barun P.S. Case No. 558 of 2022.

The application stands allowed.
