This application, for grant of anticipatory bail, arises out of Derani Police Station Case No. 87 of 2016, disclosing offences under Section 7 of the E.C. Act.

Learned counsel for the petitioner has submitted that the petitioner is not named in the F.I.R. rather the name of this petitioner has surfaced merely on the basis of suspicion as the alleged articles have been recovered from the area of the petitioner, who is a P.D.S. dealer of that area. The petitioner has no concern with the recovered articles. Therefore, no case under Section 7 of the E.C. Act is made out against this petitioner. Hence, the petitioner deserves the privilege of anticipatory bail.

Patna High Court Cr.Misc. No.231 of 2017 (3) dt.07-03-2017 Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIIth, Saran at Chapra, in connection with Derani Police Station Case No. 87 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
