JUSTICE SANJAY PRIYA ORAL ORDER 24-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Rajiv Nagar P.S. Case No. 139 of 2014 instituted for the offence under Sections 420, 406 and 34 of the Indian Penal Code. As per allegation, the agreement for sale of land was made between the informant and father of the petitioner Chandradeo Rai. From the written report it appears that money was paid to Chandradeo Rai.

The learned counsel for the petitioner has submitted that Chandradeo Rai has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 1.3.2017 passed in Cr. Misc. 8539 of 2017. The petitioner is son of Chandradeo Rai. There is no any allegation of specific overt act against the

The counsel for the informant has appeared and opposed the prayer for bail.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Rajiv Nagar P.S. Case No. 139 of 2014, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
