JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-09-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the informant is languishing in custody since 13.7.2016 in a case registered under Sections 498A, 341 and 323/34 of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act.

The basic accusation is of torture for non-fulfillment of dowry demands and making assault.

It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the informant. Though the case was registered in 2000 but since the informant performed second marriage, hence the petitioner was under impression that the case is not surviving. There is nothing on record to suggest that there is any progress in trial after arrest of the petitioner. Considering the aforesaid facts, let the above named

Patna High Court Cr.Misc. No.42766 of 2016 (2) dt.29-09-2016 2/2 petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Hilsa (Nalanda) in connection with Ekangarsarai (Parwalpur) P.S. Case No. 34 of 2000. Since the case was registered in 2000 and the petitioner was arrested on 13.7.2016, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner defaults without any reasonable cause on two consecutive occasions.
