JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-04-2017 Heard learned counsel for the petitioner and the State. The present application has been filed for quashing of the order dated 22.08.2016, passed by the learned Sub-divisional Judicial Magistrate, Madhubani, in G.R. No. 1966 of 2015 arising out of Jainagar P.S. Case No. 167/2015 (S.T No.434/2016), whereby the process has been directed to be issued after cognizance being taken for the offences punishable under Sections 302, 201 and 120B of the Indian Penal Code.

Since on conclusion of investigation and submission of Final Report (charge-sheet) the case has been committed to the Court of Session, learned counsel for the petitioner seeks permission to withdraw this application with a liberty to raise all

Patna High Court Cr.Misc. No.10781 of 2017 (2) dt.08-04-2017 2/2 the contentions at the time of framing of the charges. Permission is granted.

Accordingly, this application is disposed of as withdrawn with the aforesaid liberty.
