2. The petitioner has preferred this application for grant of regular bail in connection with Buxar Town P.S. Case No.210 of 2019 dated 12.03.2019 registered for the offences punishable under Sections 494, 498A, 323, 504, 506 and 34 of the Indian Penal Code.

As per the prosecution case, the complainant/informant was married to the petitioner on 08.12.2004, subsequently they were blessed with a female child and it is alleged that thereafter the torture was inflicted on account of giving birth to a female child and non-fulfillment of

Patna High Court CR. MISC. No.23205 of 2026(4) dt.17-06-2026 2/3 further dowry demand of Rs. 25,00,000/-. It has further been alleged that petitioner has performed second marriage.

4. Learned counsel for the petitioner submitted that the case is triable by the Court of learned Magistrate and petitioner is in custody in the present case since 12.11.2025. It has further been submitted that although petitioner has been made accused in nine other cases, but he is on bail in those cases. It has further been submitted that before filing of the present complaint/FIR, the petitioner had filed Matrimonial Suit No.124 of 2016 with a prayer for divorce on 09.06.2016 before learned Principal Judge, Family Court, Buxar and thereafter the present complaint case was filed by the complainant/informant on 16.01.2017, which came to be registered as police case on 12.03.2019. It has lastly been submitted that petitioner is ready to co-operate in the trial.

5. Learned A.P.P. for the State as well as learned counsel for Opposite Party No.2 have vehemently opposed the prayer for bail of the petitioner. It has further been submitted that petitioner has performed second marriage and petitioner has not complied the order for maintenance as directed while granting anticipatory bail to the petitioner by this Court.

Considering the facts and circumstances of the case as well as the period of custody, the petitioner above-named is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar, in connection with Buxar Town P.S. Case No. 210 of 2019.

8. The application stands allowed.
