====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 25-11-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Lauriya P. S. Case No.15 of 2021, instituted for the offences under Sections 413, 414/ 34 of the Indian Penal Code and Sections 25(1-B)a, 26, 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 16.01.2021 and he is a person with clean antecedent, charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that informant alleges that from this petitioner and Avinash Kumar, one black colour super splendor motorcycle without registration number and specifically from this petitioner

Patna High Court CR. MISC. No.31168 of 2021(2) dt.25-11-2021 2/2 a live cartridge of .315 bore and one Samsung mobile is alleged to have been recovered.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case and is languishing in jail.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 16.01.2021 and he is a person with clean antecedent, charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Bettiah, West Champaran in connection with Lauriya P. S. Case No.15 of 2021.

The application stands allowed.
