JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 03-05-2017 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners apprehend their arrest in connection with Rahika P.S. Case No. 142 of 2016, registered for the offences punishable under Sections 341, 323, 379, 498(A), 494/34 of the Indian Penal Code and Section 3/4 of D.P. Act. The petitioners are Dewar and father-in-law of the informant, there is general and omnibus allegations against the husband and other in-laws that they demanded cash of rupees one lakh and motorcycle by way of dowry to start business for the husband and due to non-fulfillment they started torturing her and caused threats to kill her lastly they ousted her from in-laws house and the husband of the informant performed another

Patna High Court Cr.Misc. No.13654 of 2017 (2) dt.03-05-2017 2/2 marriage with the daughter of Mohan Pawan, there is no specific allegation against them and, as such, they deserve sympathetic consideration.

The learned A.P.P. opposes the prayer of pre-arrest bail.

In the facts and circumstances as stated above, the petitioners in the event of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Madhubani, in connection with Rahika P.S. Case No. 142 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
