Petitioner seeks bail in Forbesganj P.S. Case No.192 of 2018 instituted for the offence under Section(s) 307 and other allied sections of Indian Penal Code.
Counsel for the petitioner submits that there is case and counter case for the same occurrence. Petitioner has lodged Forbesganj P.S. Case No.191 of 2018 against informant and his family members. In that case, petitioner has sustained one grievous injury. Injury report of this petitioner is enclosed as Anneuxre-4.
In the instant case, it is alleged this petitioner assaulted the son of informant, Arbind Sah, by farsa on his head. Injury report of Arbind Kumar is enclosed as Annexure-3,
Patna High Court Cr.Misc. No.68951 of 2018(2) dt.29-11-2018 2/2 wherein, Doctor has found Injury Nos.1 and 2 to be simple in nature and Injury No.3, which is pain in left hand, was found to be grievous. All the injuries were caused by hard and blunt substance.
Petitioner is in custody since 11.08.2018.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No.192 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
