The petitioner seeks bail in Mahua P.S. Case No.36 of 2020, registered under Sections 30(a), 32(i), 34(i), 38(i) and 41(ii) of the Bihar Prohibition and Excise Act. The informant, S.I. of Mahua P.S., alleged that he got secret information that liquor was kept in the house of Badal Kumar. On such information, the informant and other police officials went to raid the house of Badal Kumar. When they reached near the house of Badal Kumar, the informant saw four persons fleeing away. On chase, two persons, namely, Badal Kumar and Raushan Kumar @ Lala Kumar were apprehended. The apprehended accused disclosed the name of Pramod Sahni and Rajesh Singh who managed to flee away. On search in the

Patna High Court CR. MISC. No.19883 of 2020(2) dt.25-06-2020 2/2 house of Badal Kumar 232 litres of foreign liquor of different brands was recovered.

Learned counsel for the petitioner submits that nothing has been recovered from possession of the petitioner. The petitioner was simply sitting on the darwaza of Badal Kumar from whose house huge quantity of foreign liquor was recovered. The petitioner is in jail since 27.01.2020. Taking into consideration the facts aforesaid, petitioner, namely, Raushan Kumar @ Lala Kumar is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cumExcise Court, Hajipur, Vaishali in connection with Mahua P.S. Case No.36 of 2020.
