2. The petitioner apprehends his arrest in connection with CR-O, no. 1/22 GO (NDPS) 1/22 registered under Sections 27 (b) (ii) 28 (A) (ii) and 36 AC of Drugs and Cosmetic Act.
3. It is alleged that petitioner was running a medical shop without having license and on raid several medicines were recovered.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that the complaint case has been filed after a delay of about one month without reasonable explanation. The allegation alleged in the
Patna High Court CR. MISC. No.24979 of 2024(2) dt.08-05-2024 2/2 F.I.R. against the petitioner of running medical shop without license is totally false and concocted. The license of the petitioner has expired in the year 2014, thereafter, he applied for renewal of the same which is still pending before higher authorities. The petitioner has got no criminal antecedent.
5. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional District JudgeI, Madhubani in connection with CR-O, no. 1/22 GO (NDPS) 1/22, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
