Because of the fact that process under Section 82 Cr.P.C. has already been issued against the petitioner. Consequent thereupon, instant petition for anticipatory bail became nonmaintainable as has been held and reported in (2014) 2 SCC 171. Accordingly, instant petition is dismissed with a direction to the petitioner to surrender before the learned lower Court with a prayer for bail, which will be considered by the learned lower Court in the background of having other co-accused released on regular bail at an earlier occasion.
