JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Bibhutipur P.S. Case No. 23 of 2017 registered under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code. The accusation is that in the light of order passed in C.W.J.C. No. 15459 of 2014, an inquiry was started about the verification of the certificates of Panchayat teachers appointed since 2006. In that course, market sheet of the petitioner, who was posted as Penchayat teacher at Primary School, Mohanpur, Ward No. 13, Bibhutipur, District- Samastipur, was sent to the Bihar School Examination Board, where it was detected that the mark sheet and certificate of the petitioner was found forged and

Learned counsel for the petitioner submits that the mark sheet bearing Roll Code -06403, Roll No. 0035, has not been sent for verification to the Bihar School Examination Board, which would appear from annexure 2 series to the supplementary affidavit. In fact, the certificate and mark sheet of one Anand Kuamr, bearing Roll Code 06403, Roll No.0135 were sent to the Bihar School Examination Board for verification. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Rosera, in connection with Bibhutipur P.S. Case No. 23 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
