JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 147, 341, 323, 337, 427 and 353 of the Indian Penal Code and Section 3 of the Bihar Medical Protection Act.

Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that there is general and omnibus allegation against the petitioner and others. As a matter of fact, one person died in the hospital and due to that petitioner and other accused persons, as alleged, had assembled at the hospital and damaged hospital's properties. As such, there is no specific allegation against the petitioner. Heard learned A.P.P. also. He has opposed the prayer for anticipatory bail.

Patna High Court Cr.Misc. No.8195 of 2017 (2) dt.28-02-2017 2/2 Considering the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, the same is rejected.

However, petitioner is directed to surrender in the court below, i.e., learned C.J.M., Araria, in connection with Narpatganj P. S. Case no. 179 of 2016 and make prayer for regular bail which will be considered on the basis of the materials available on record and also considering the fact that specific allegation is against the other accused persons without being prejudiced by the order of this Court.
