The instant application for regular bail has been filed by the petitioner in connection with Kaluahi P.S. Case No. 228 of 2022 instituted for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 302, 120(B) of the Indian Penal Code.
Earlier the application for regular bail of the petitioner was rejected by order dated 10.08.2023 passed in Cr. Misc. No. 40951 of 2023 with an observation to learned trial court to expedite the trial and conclude the same as soon as possible.
Patna High Court CR. MISC. No.23809 of 2024(3) dt.26-04-2024 2/2 In pursuance to the direction of this Court, a report, dated 20.03.2024, with regard to present stage of trial has been received and the same is kept at flag 'R'. From its perusal it appears that three witnesses have been examined and the trial is likely to be concluded within eight months.
No fresh ground is made for reconsideration of the regular bail of the petitioner. Accordingly, prayer for grant of regular bail is rejected.
Accordingly, petition stands disposed off.
However, learned trial court is directed to conclude the trial within six months., failing which, the petitioner will be at liberty to renew his prayer of bail.
