JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Sahebganj P.S. Case No. 313 of 2014 registered for the offences punishable under Sections 341, 323, 353, 307, 504/34 of the Indian Penal Code.

Almost, all the sections are bailable in nature except Sections 353 and 307 of the Indian Penal Code. So far as Section 307 of the Indian Penal Code is concerned, it is only alleged that petitioner pressed the neck of one driver but admittedly, no injury has been found on the neck of concerned driver. So far as Section 353 of the Indian Penal Code is concerned, admittedly, the entire occurrence took place in the business premises of the petitioner.

Patna High Court Cr.Misc. No.47945 of 2014 (4) dt.23-06-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Muzaffarpur (West) in Sahebganj P.S. Case No. 313 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C.
