1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Kalyanpur P.S. Case No. 391 of 2024 dated 23.11.2024 registered under Sections 127(1), 115(2), 118(1), 303 (2), 351 (2), 74, 352 & 3(5) of the Bharatiya Nyaya Sanhita, 2023.

As per the prosecution case on 19.11.2024 the petitioner alongwith other accused persons, eight in number, arrived at the door of the informant and due to land dispute started abusing her and when objected the accused persons assaulted the informant by means of 'farsa' on her head due to which she sustained injury. When the son of the informant intervened, the co-accused assaulted him by means of 'dab' on his head. The

Patna High Court CR. MISC. No.20786 of 2025(2) dt.23-04-2025 2/3 younger son of the informant was also assaulted by another co-accused with an intention to kill by means of iron rod.

4. Learned counsel for the petitioner submits that the petitioner has been made accused due to land dispute between the parties which would be evident from the F.I.R. itself. A counter case has been lodged by the side of the petitioner bearing Kalyanpur P.S. Case No. 406 of 2024 against the informant and others. The allegation against the petitioner is not specific whereas specific allegation has been made against other accused persons.

Regard being had to the submission made by the parties, taking into consideration the fact that there is general and omnibus allegation against the petitioner, the petitioner is having no criminal antecedent and due to land dispute case and counter case has been lodged, accordingly, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-12, East Champaran,
