Submission of the learned counsel for the petitioner is that earlier the prayer for anticipatory bail of the petitioner was permitted to be withdrawn by mistake though he has not surrendered but as submission has been made he has been taken into custody and the other accused persons have been granted bail by this Court. The aforesaid fact will appear from the order dated 12.9.2018 passed in Cr. Misc. No.51279 of 2018. Heard learned APP.

Having heard both sides and in view of the facts and circumstances as stated above, let the petitioner surrender before the learned court below within a period of six weeks from the date of receipt of the order and pray for regular bail and the learned court below considering the aforesaid aspect of the

Patna High Court Cr.Misc. No.69224 of 2018(2) dt.28-11-2018 2/2 matter and also considering the fact that the other accused persons have been granted anticipatory bail by this Court, shall dispose of the application of the petitioner if possible on the same day.
