JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-11-2018 The petitioner seeks regular bail in connection with Purnea Sadar P.S. Case No. 488 of 2018, registered for offences punishable under Sections 147, 148, 149, 332, 333, 336, 353, 307, 427, 290, 435, 323 and 341 of the Indian Penal Code. Allegation as per F.I.R. is that in an incident two persons died and when police reached the place of occurrence, thereafter mob has assembled there and assaulted the police party and petitioner is also named as one of the member of the mob.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and no specific allegation has been attributed against the petitioner and he is in judicial custody since 02.09.2018.

Heard learned A.P.P. also.

No.68068 of 2018(2) dt.29-11-2018 2/2 Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Purnea Sadar P.S. Case No. 488 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
