The matter has been listed under the heading "For Orders" under the orders of Hon'ble the Chief Justice.

Learned counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks from the date of lifting of the lockdown in the State of Bihar. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Section 420 of the Indian Penal Code and Sections 28/28A/27(D) Drugs and Cosmetics Act.

Allegedly, the petitioner along with one another was apprehended by the police with blood bags. On demand, no paper or document in respect of recovered blood was produced.

It has been submitted on behalf of the petitioner that the petitioner

Patna High Court CR. MISC. No.21201 of 2020(3) dt.03-09-2020 2/2 has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 21-04-2020. The petitioner has been made accused in the present case due to mistake of fact. He has no concern with the pouch of blood in question. It has further been submitted that the petitioner may be released after completion of six months in custody.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances and also the lockdown, it is directed that after completion of six months in custody, let the petitioner, above named, be released on bail on his personal bond to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Patna in connection with Jakkanpur P.S. Case No. 225 of 2020. Once the normalcy is restored, the petitioner shall furnish bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each within a period of four weeks to the satisfaction of the court concerned in connection with the aforesaid case.
