JUSTICE SATYAVRAT VERMA ORAL ORDER 06-05-2022 Heard learned counsel for the petitioners and learned APP for the State through video conferencing. The petitioners seek bail in a case registered for the offences punishable under Sections 30(a) and 56(b) of the Excise Act, 2018.

The learned counsel for the petitioners submits that the petitioners are in custody since 05.03.2022, they are persons with clean antecedent and prosecution report has been submitted in this case.

Allegation is of recovery of 117 litre of liquor from a carton kept in Tata Indigo.

The learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.22159 of 2022(2) dt.06-05-2022 2/2 petitioner no.1 is the driver and petitioner no.2 had taken lift and as such, they were not knowing what the owner had kept in the car.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioners are in custody, they are persons with clean antecedent and prosecution report has been submitted in this case, the petitioners, abovenamed, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 2,000/- (Rupees Two Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Excise Case No.132 of 2022.

The application stands allowed.
