JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-11-2018 The petitioner seeks regular bail in connection with Forbesganj P.S. Case No. 460 of 2018, registered for offences punishable under Sections 399 and 402 of the Indian Penal Code and Section 25(1-b)a/26/35 of the Arms Act.

Allegation as per F.I.R. is that police on informant that some persons have assembled for preparation of commission of dacoity, raided the place and recovered one mobile phone from the petitioner and from co-accused one country made pistol was recovered.

It has been submitted on behalf of the petitioner that no arms and ammunition or any incriminating material has been recovered from the possession of the petitioner and he has been made accused only on the basis of suspicion. Further

Patna High Court Cr.Misc. No.68500 of 2018(2) dt.30-11-2018 2/2 he has no criminal antecedent and he has been in judicial custody since 22.06.2018.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No. 460 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
