JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 01-12-2016 Heard learned counsel for the petitioner as well as learned APP for the State.

Though petitioner has got chequered history but his presence so far as instant case is concerned, is on the basis of disclosure having been made by co-accused and on account thereof, is under custody since 12.08.2016.

In the aforesaid facts and circumstances of the case, petitioner, Prem Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of ACJM, XIII, Vaishali at Hajipur in connection with Sarai PS Case No. 82 of 2016 with a condition that one of the bailors should be a government servant whose identity the learned lower court will ascertain from his head office of the department of which the aforesaid bailor belongs to as well

Patna High Court Cr.Misc. No.51846 of 2016 (2) dt.01-12-2016 as the aforesaid bailor will also give an undertaking that henceforth petitioner will not indulge himself in any kind of criminal activity apart from having independent undertaking at the end of the petitioner also. In case of violation, the amount of bail bond will be subject to forfeiture which the learned lower court will realize apart from ceasing the privilege. (Aditya Kumar Trivedi, J) perwez U T
