The petitioner apprehends his arrest in Complaint Case No. 1922 of 2015 instituted for the offence under Section (s) 420 of the Indian Penal Code.
It has been submitted that petitioner was the agent of Sahara India Finance Company. He, with consent of the complainant deposited her amount in Pratigya Housing Finance & Construction Company Limited and gave certificate and receipt against the deposit. The fraud has been committed by the Pratigya Housing Finance & Construction Company Limited. From the complaint petition itself, it appears
Patna High Court Cr.Misc. No.7905 of 2017 (2) dt.23-02-2017 2/2 that complainant has stated that this petitioner gave her certificate and receipt of the deposit in Pratigya Housing Finance & Construction Company Limited in the year 2013-14. In such circumstance, this Court finds that the money of the complainant was deposited in Pratigya Housing Finance & Construction Company Limited with consent of the complainant.
In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Complaint Case No. 1922 of 2015, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IV, Samastipur, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
