Opposite Party/s ====================================================== CORAM: HON'BLE MR JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 20-02-2015 All these four applications are in respect of Azamnagar Police Station (PS) Case No 33 of 2014 registered under Sections 147, 148, 149, 447, 341, 323, 307, 302, 337, 114, 506, 427 of Indian Penal Code.
Learned counsel for the petitioners points out that apparently non-issue had been made an issue resulting in the death of the son of informant. From the first information report, it is clear that the dispute started with use of an electric generator and escalated. Informant's main allegation is directed against his own elder brother Noor Alam and the generator operator Piluwaha @ Mahboob and Mushir Uddin. All others are just members of unlawful assembly.
Be that as it may, in the event of their arrest or surrender within four weeks from today, the petitioners abovenamed shall be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of
Patna High Court Cr.Misc. No.36290 of 2014 (2) dt.20-02-2015 the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in Azamnagar PS Case No 33 of 2014 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
