Mr. Sri Madan Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-12-2018 The petitioner seeks bail in connection with Alamganj P.S.Case No. 278 of 2018 registered under Sections 379 and 411 of the Indian penal Code.

Allegation against the petitioner is of theft of motorcycle of the informant. Petitioner is not named in the FIR. Submission of learned counsel for the petitioner is that petitioner has been made accused on the basis of confessional statement of co-accused through there is no recovery from the possession of the petitioner and he is in custody for four and half months.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/-

Patna High Court Cr.Misc. No.68576 of 2018(2) dt.03-12-2018 2/2 (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Patna City in connection with Alamganj P.S. Case No. 278 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
