JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 24-02-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered in connection with Bettiah ( Muffasil) P.S.Case No. 724 of 2020 for the offences punishable under Sections 147, 149, 323, 353, 386,387 of the Indian Penal Code. As per allegation in the F.I.R, some accused persons including the petitioner gathered and playing gambling and after seeing the police team, they fled away, leaving their goods and motorcycles and also causing hindrance in discharging the official duty.
Learned counsel for the petitioner submits that petitioner has falsely implicated in this case. There is general and omnibus allegation against the petitioner. Neither he was
Patna High Court CR. MISC. No.33654 of 2021(2) dt.24-02-2022 2/2 caught on the spot nor any incriminating article has been recovered from his possession. On similar footing other coaccused persons have been granted bail by this Court in Cr. Misc. No. 30381 of 2021vide order dated 15.02.2022 and Cr. Misc. No. 31140 of 2021 vide order dated 15.02.2022. Learned Additional Public Prosecutor opposes the bail prayer of the petitioner.
Considering the facts and circumstance of the case as well as submission of the parties, let the above named petitioner, in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah ( Muffasil P.S.Case No. 724 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C N.K/- (Sunil Kumar Panwar, J) U T
