The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 342, 323, 307, 504/34 of the Indian Penal Code, 27 of the Arms Act and 3(1)(x) of SC/ST (Prevention of Atrocities) Act. The prosecution case is that one Sanjay Choudhary abused the informant for uprooting cauliflower, thereafter all the accused persons assaulted the informant with kick and fists. Villagers came to rescue then Sanjay Choudhary resorted to fire, thereafter, accused persons again assaulted the informant.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.41799 of 2015 (2) dt.09-10-2015 2/2 petitioners that the specific accusation is against Sanjay Choudhary and for the petty dispute the accusation has been levelled whereas the anticipatory bail application of co-accused Guddu Kumar and Sanjay Choudhary has been allowed by a coordinate Bench of this Court with direction to the learned court below to release them on bail, if it is found that the informant has not received injury.

Considering the nature of accusation, it is a case for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Matihani P.S. Case No. 09 of 2015 pending in the court of learned Judicial Magistrate, Ist Class, Begusarai.

With the aforesaid observation, this application is disposed of.
