2. Petitioner apprehends arrest in a case registered for the offence punishable under section 272, 723 of the Indian Penal Code and Section 30 (a) of Bihar Prohibition and Excise Act.
3 . It is alleged that 452.625 liters of illicit foreign liquor and 70.00 liters of illicit spirit were recovered from an open place and this petitioner is alleged to have fled away from the spot.
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case on the basis of suspicion . Recovery has been made from an open place which is accessible to one and all. No incriminating material has been
Patna High Court CR. MISC. No.21131 of 2025(2) dt.23-04-2025 2/2 recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner has got 2 criminal antecedent out of which 1 is of similar nature and in both cases he is on bail.
5 . Learned counsel for the State opposes the bail petition .
6. Considering the fact that recovery has been made from an open place and other circumstances of case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive special Judge Excise Court No. II Muzaffarpur in connection with Paroo Police Station Case No. 35 of 2021 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
