JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-05-2019 This is an application for grant of anticipatory bail in connection with Kotwali P.S. Case No. 598 of 2018, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation as per F.I.R. is that the petitioner is engaged in the liquor trade and on that information police raided the place, the petitioner succeeded in fleeing away leaving a car and from that car altogether 140 liters of liquor has been recovered and it further appears that the petitioner is accused in five other cases.

Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case only on the basis of suspicion.

Patna High Court CR. MISC. No.20339 of 2019(2) dt.07-05-2019 2/2 Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail of the petitioner on the ground that the petitioner has criminal antecedents as well as on the fact that the public has identified the petitioner.

Having heard both sides, in view of the facts and circumstances of the case and criminal antecedents of the petitioner, I am not inclined to grant anticipatory bail to the petitioner.

Accordingly, this application is dismissed.
